Information We May Collect About You

(c) Characteristics of protected classifications under California or Federal Law such as age, gender, etc.;

(d) Commercial Information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;

(e) Biometric information;

(f) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement;

(g) Geolocation data;

(h) Audio, electronic, visual, thermal, olfactory, or similar information (Note: Calls are recorded and may be monitored);

(i) professional and employment related information,

(j) Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99);

(k) Inferences drawn from other information. 

(l) Sensitive Personal Information. 

Personal information does not include: Publicly available information from government records; Deidentified or aggregated consumer information; Information excluded from the CCPA’s scope, such as:

Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”) or clinical trial data; personal information covered by the Fair Credit Reporting Act (“FCRA”), the Gramm-Leach-Bliley Act (“GLBA”) or California Financial Information Privacy Act (“FIPA”), and the Driver’s Privacy Protection Act of 1994.

We collect most of this personal information from our clients or from you or your authorized representative by telephone or by electronic or other written communications. We may also collect information from our service providers, from third parties and from third parties with your consent;

We will retain this personal information so long as reasonably required in accordance with our data retention policies and procedures and is required by applicable law.

A California resident has the right to request through a verifiable consumer request that we delete personal information, subject to certain exceptions. If the information we maintain about you falls into one or more exceptions, we may not be able to delete the information. 

A California resident has the right to request through a verifiable consumer request that we correct inaccurate personal information, subject to certain exceptions and the nature of the personal information.

To exercise your rights please provide your full name, address, date of birth, account number if applicable, and the last four numbers of your Social Security number by Emailing us at staff@hpsears.com or calling us at 1-888-269-7051. Please note that you may only make a request twice within a 12-month period.

We do not sell personal information to third parties. 

A consumer has a right not to receive discriminatory treatment by us for the exercise of the privacy rights conferred by the California Consumer Privacy Act.

A consumer can designate an authorized agent to make a request under the California Consumer Privacy Act by sending us a notarized power of attorney or notarized written authorization.

Changes to This Privacy Policy

We may revise this Privacy Policy from time to time. Modifications go into immediate effect after they have been posted. See the last updated date at the end of this Privacy Policy. If you do not agree with the policy, you should cease use of the site immediately.
